NATURE OF MEETING

The City will consider amendments to Section 17.05.300 (C) – Notice of Application for Type II Decision; Section 17.05.400 (C) Notification Requirements for Type III Decision and Section 17.05.600 (H) - General Procedural Provisions, City Council Review in the Central Point Municipal Code.

The purpose of the amendment is to increase the area required for public notice of meetings from 100 feet to 250 feet to ensure the dissemination of information about planning actions conducted by both the City Planning Commission and the City Council. The amendments also include on-site posting of notices and City Council Review Provisions. Applicant: City of Central Point.

Pursuant to ORS 197.763 (3) (e), failure to raise an issue during this hearing, in person or in writing, with sufficient specificity to afford the decision-makers and the parties an opportunity to respond to the issue will preclude an appeal based on that issue.

CRITERIA FOR DECISION

Criteria for minor zoning code text amendment are set forth in Section 17.10.400 of the Central Point Municipal Code.

PUBLIC COMMENTS

  1. Any person interested in commenting on the above-mentioned land use decision may submit written comments up until the close of the meeting scheduled for Tuesday, November 7, 2017. 
  2. Written comments may be sent in advance of the meeting to Central Point City Hall, 140 South Third Street, Central Point, OR 97502 or by e-mail to tom.humphrey@centralpointoregon.gov.
  3. Issues which may provide the basis for an appeal on the matters shall be raised prior to the expiration of the comment period noted above.  Any testimony and written comments about the decision described above will need to be related to the proposal and should be stated clearly to the Planning Commission.
  4. A copy of the City’s staff report and recommendation to the Planning Commission shall be available for review at no cost at least seven (7) days before hearing.  Copies of the same shall be provided upon request at a reasonable cost. 
  5. Copies of all evidence relied upon by the applicant are available for public review at City Hall, 140 South Third Street, Central Point, Oregon.  The City File Number is: CA-71002.  Copies of the same are available at .25 cents per page.

SUMMARY OF PROCEDURE

At the meeting, the Planning Commission will review the application and technical staff report.  Any testimony or written comments must be related to the criteria set forth above.  At the conclusion of the review, the Planning Commission will forward a recommendation to the City Council to approve, approve with modifications or deny the minor zoning code amendments. 

On November 9, 2017 the City Council will consider the Planning Commission’s recommendation and will hear testimony and arguments on the application. Any testimony or written comments must be related to the criteria set forth above.  At the conclusion of the review, the City Council will direct staff to prepare for consideration at the December 14, 2017 Council meeting a final order to approve, approve with modifications, or deny the minor zoning code amendments.
